Section 51
Jurisdiction and Limitation to be Decided

(1) Notwithstanding anything else written in this Code, if a question is raised that the court has no jurisdiction, the plaintiff does not have the right to file a case, or the statute of limitations, when the accused makes a statement in relation to a case or the defendant submits a reply, the court shall decide the case only after first deciding on such a question. Other actions should be taken forward and if it is not within its jurisdiction, it should be ordered to be sent to the court having jurisdiction.
(2) An appeal may be made to the court hearing the appeal within thirty days from the date of such decision.
(3) The question which has been decided in accordance with sub-section (1) or (2) cannot be raised again in the court hearing the appeal. But this provision will not be applicable in case of interim order in the course of the case.
